Terms of Service

1. Eligibility

You must be at least 18 years old and capable of forming a binding contract to use the Service as a recruiter or team member. If you participate in an interview as a candidate, you must have received a valid invitation from an employer organization using Pre-cruit and must comply with any additional instructions provided in that invitation.

You may not use the Service if you are barred from doing so under applicable law or if we have previously suspended or terminated your access.

2. User accounts

To access certain features, you must create an account. You may register using Google OAuth, email verification, or other methods we make available. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.

You agree to provide accurate information and to keep your account information up to date. Notify us promptly at kartik@thinktank-ventures.com if you suspect unauthorized access to your account.

Organization administrators are responsible for managing team access and for ensuring that invitations are sent only to appropriate candidates and reviewers.

3. The Service

Pre-cruit provides tools for employer organizations to configure interview questions, invite candidates, collect asynchronous video and audio responses, and review submissions. Pre-cruit does not make hiring decisions, score candidates, or guarantee employment outcomes.

We may modify, suspend, or discontinue any part of the Service at any time. We will use reasonable efforts to provide notice of material changes where practicable.

4. Acceptable use

You agree not to use the Service to:

• Violate any applicable law, regulation, or third-party rights;
• Upload, record, transmit, or store content that is illegal, offensive, harassing, defamatory, fraudulent, or infringing on intellectual property or privacy rights;
• Submit video or audio recordings that you do not have the right to share, or that contain unlawful, offensive, or infringing material;
• Impersonate any person or entity, or misrepresent your affiliation with an organization;
• Interfere with or disrupt the Service, circumvent security measures, or access accounts or data without authorization;
• Use the Service to build a competing product or to scrape, mine, or harvest data except as permitted by these Terms; or
• Reverse engineer, decompile, or attempt to extract source code from the Service except where prohibited by law.

We reserve the right to investigate violations and to remove content or suspend access where we reasonably believe these Terms have been breached.

5. Employer responsibilities

If you use Pre-cruit as an employer or hiring team, you are solely responsible for your recruiting practices and for compliance with applicable local labor, employment, anti-discrimination, and privacy laws when inviting candidates, collecting responses, and analyzing candidate videos.

You are responsible for providing candidates with any notices, consents, or disclosures required by law before or at the time of collection. Pre-cruit provides infrastructure to facilitate interviews; it does not provide legal advice and does not assume your compliance obligations.

6. Candidate submissions

When you complete an interview as a candidate, you grant the inviting employer organization the right to access and review your submissions for recruitment purposes. You represent that your submissions are your own (or that you have all necessary rights to submit them) and that they comply with these Terms.

7. Intellectual property

Pre-cruit and its licensors own all rights, title, and interest in the Service, including software, design, branding, and documentation, subject to any rights expressly granted to you under these Terms. These Terms do not grant you any ownership interest in the Service.

You retain ownership of content you submit, subject to the licenses you grant to employer organizations and to us as necessary to operate the Service (including hosting, processing, transmitting, and displaying content). Feedback you provide may be used by us without restriction or compensation.

8. Privacy

Our collection and use of personal information is described in our Privacy Policy, which is incorporated into these Terms by reference.

9. Termination

You may stop using the Service at any time. We may suspend or terminate your access, with or without notice, if we reasonably believe you have violated these Terms, pose a security risk, or if required by law.

Upon termination, your right to use the Service ceases immediately. Provisions that by their nature should survive termination — including intellectual property, disclaimers, limitation of liability, and governing law — will survive.

10. Disclaimers

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF DATA LOSS.

11. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, PRE-CRUIT, THINKTANK VENTURES LLP, AND THEIR OFFICERS, PARTNERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR BUSINESS OPPORTUNITIES, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE.

PRE-CRUIT IS NOT LIABLE FOR EMPLOYMENT OUTCOMES, HIRING DECISIONS, OR ACTIONS TAKEN BY EMPLOYER ORGANIZATIONS OR CANDIDATES BASED ON INTERVIEW SUBMISSIONS. PRE-CRUIT IS ALSO NOT LIABLE FOR DATA PROCESSING FAILURES, INTERRUPTIONS, TRANSMISSION ERRORS, OR UNAUTHORIZED ACCESS BEYOND OUR REASONABLE CONTROL.

OUR TOTAL AGGREGATE LIABILITY FOR ANY CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID TO PRE-CRUIT FOR THE SERVICE IN THE TWELVE (12) MONTHS BEFORE THE CLAIM AROSE, OR (B) ONE HUNDRED U.S. DOLLARS (USD $100).

Some jurisdictions do not allow certain limitations of liability; in those cases, the above limitations apply to the fullest extent permitted by law.

12. Indemnification

You agree to indemnify and hold harmless Pre-cruit and Thinktank Ventures LLP from any claims, damages, losses, and expenses (including reasonable legal fees) arising out of your use of the Service, your content, your violation of these Terms, or your violation of any law or third-party rights.

13. Governing law

These Terms are governed by the laws of India, without regard to conflict-of-law principles. Courts in Gautam Buddha Nagar, Uttar Pradesh, India shall have exclusive jurisdiction over disputes arising from these Terms, subject to mandatory consumer protections that may apply in your jurisdiction.

14. Changes to these Terms

We may update these Terms from time to time. We will post the revised Terms on this page and update the “Last updated” date. Continued use of the Service after changes become effective constitutes acceptance of the revised Terms.
